Legal battle cuts off HOA’s funding to remove Sissoo trees in Scottsdale neighborhood

Property owners who don’t want their Sissoo trees cut down by the homeowners association in the plush Arcadia at Silverleaf neighborhood won what they describe as a crucial battle in court recently.

They hope the victory will effectively put an end to the four-year battle over the trees in the neighborhood, which is part of the larger DC Ranch community.

Maricopa County Superior Court Judge Randall H. Warner ruled that the HOA needed to have a vote of the homeowners to assess a fee to fund a project to eliminate the trees in some homes – which it did not do.

The homeowner’s association began removing the trees back in the fall of 2021 and charging everyone in the neighborhood for it, without a vote.Homeowner Tom LaPorte figures the removal cost around $4 million.
So LaPorte, with the financial backing of others in the neighborhood, sued the HOA.
